# Is buying off-plan in Koh Samui safe? How to check a developer

Off-plan can be a sensible way to buy on Koh Samui, or a costly mistake. Here are the real risks and a plain checklist to run before you pay a deposit.

Buying off-plan on Koh Samui is safe enough when the developer has already handed over similar villas, and you pay in stages as the build goes up. It is risky when the developer has nothing standing, a polished render and wants most of the money up front. Off-plan means buying before the building is finished, from drawings and a written specification.

The island is the same in both cases. The developer and the contract are what change.

We design, build and sell villas on Koh Samui, including off-plan, and we would rather you checked us properly than took our word for it. This guide covers what really goes wrong and the checks that catch it.

*This is general information, not legal or financial advice. Every plot, title deed and contract is different. Before you pay a deposit, have the developer, the ownership structure and the sale contract checked by an independent Thai property lawyer you choose yourself.*

## The short answer

- **The main risk is delivery.** Will the developer finish what was drawn, on time and to the specification?
- **Evidence beats promises.** Dated, finished buildings you can visit tell you more than any render.
- **Ask for a project they finished and sold.** A developer who has done the whole job, from land to buyer, has been tested.
- **Protect your money and your title.** Pay in stages tied to real build milestones. Have your own lawyer check the land title and the contract.
- **This guide is about Koh Samui villas.** Rules and habits here differ from Thai condominiums and from your home country.

## Why people buy off-plan at all

Off-plan has real advantages. You can often get an earlier choice of plot or position in a scheme.

You may get a say in some of the finishes. And you pay across the build instead of all at once.

The job is to keep those advantages without carrying all the risk. That starts with naming the risks plainly.

## The four things that go wrong

Every check later in this guide matches one of these four risks.

### 1. The villa is not finished

This is the big one. The developer runs out of money, manages the build badly, or was never able to finish. The villa arrives late, half-done or not at all.

Off-plan puts this risk on you because you commit before the villa exists. The defence is track record. A developer who has finished and handed over similar villas has already done the hardest part.

### 2. Your money is paid too early

How you pay matters as much as how much. If most of the price is due before much is built, the developer holds your money and you hold the risk.

Payments released at real, checkable stages keep the pressure to finish where it belongs. Typical stages are foundations, structure, roof, fit-out and handover.

Ask your lawyer whether escrow is possible for your deal. Escrow means a neutral party holds your money until agreed conditions are met.

### 3. The title or ownership is weak

A good villa on land with a weak title is a problem you inherit. Ideally the land has a chanote, the strongest and fully surveyed Thai title deed (also called Nor Sor 4 Jor).

How you hold the villa must also be sound and must transfer cleanly to you. Common routes include a registered lease, a Thai company or another registered right. A lease means you hold the property for a fixed number of years rather than owning it outright, which is called freehold.

This is a job for your lawyer. We explain the basics in [how foreign ownership works on Koh Samui](/articles/can-foreigners-own-property-thailand-koh-samui) and [leasehold versus freehold for villa buyers](/articles/leasehold-vs-freehold-koh-samui).

### 4. The finished villa does not match the render

Renders flatter. Finishes, materials, ceiling heights and pool size can all shrink between the drawing and the keys.

The defence is a detailed contract and proof that this developer's finished work matches what they draw. A developer who is confident here will happily show you a finished villa next to its original render.

## How to check a developer

None of this needs special knowledge. It needs you to ask, and to walk away if the answers are thin. Work through each check and note what a good answer looks like.

### Finished buildings you can visit

- **Why it matters:** renders and half-built sites prove nothing about finishing.
- **A good answer:** you are invited to walk through finished villas, with completion dates you can check.

### A project finished and sold

- **Why it matters:** finishing and handing over is the hardest part of the job.
- **A good answer:** the developer names a villa they built and sold, start to finish.

### Still running what they built

- **Why it matters:** a developer who runs its buildings stays accountable after handover.
- **A good answer:** they still manage or let properties they finished years ago.

### Checkable outside their own marketing

- **Why it matters:** a real developer can be found and cross-checked.
- **A good answer:** a developer profile on property sites such as FazWaz, Hipflat or HomesThailand that matches the scheme.

### A sound title and ownership structure

- **Why it matters:** a weak title or structure becomes your problem.
- **A good answer:** your own lawyer confirms the title and the transfer, not the seller's lawyer.

### Payments tied to real milestones

- **Why it matters:** money paid too early removes the pressure to finish.
- **A good answer:** each payment is released at a stage you can see, with the balance due at handover.

### A clear contract

- **Why it matters:** vague contracts favour the seller.
- **A good answer:** a completion date, a full specification, and what happens if the build is late or never finished.

### Your own lawyer

- **Why it matters:** the seller's lawyer works for the seller.
- **A good answer:** you hire an independent Thai property lawyer before any money moves.

A serious developer will answer most of these easily and will not flinch at the rest. Pressure to pay fast, or a portfolio of renders with no addresses, are the warning signs.

## Our own record against the checklist

It would be hollow to give you that checklist and not answer it ourselves. Here is our record. Hold us to the same test.

![Entrance of South Beach Inn at night on Thong Krut Beach, Koh Samui](/api/media/file/mcp-167a373c0b2734a380db80fc5a3fcb3c-m169-is-off-plan-safe-koh-samui-vet-developer-inbody-after.webp?prefix=recovery%2Fd92510ab-89c5-471f-b0e3-d343c4ea5cd6&2026-10-10T06%3A55%3A00.153Z)

**Finished buildings you can visit.** [South Beach Inn](/developments/south-beach-inn), our eight-room hotel on Thong Krut Beach, opened in March 2025. You can stay there and look round.

At [Portofino Village](/developments/portofino-village) above Lipa Noi, Villa Emerald and the first Villa Pearl plot are completed, and another villa there is finished and let. Buyers can walk through finished villas instead of judging the scheme from a brochure.

**A villa built and sold.** We built [Villa Picasso Ko Samui](/developments/villa-picasso-taling-ngam), a five-bedroom sea-view villa in Taling Ngam. It was completed in 2022 and has since been sold. That is the full cycle from build to buyer, on this island.

**Still running what we built.** Our rental team, ATS Luxury Stays, runs the villas we built or rebuilt on one road in Laem Sor. They rate 4.7 to 4.9 on Airbnb, [Villa Malibu](/developments/villa-malibu) among them. Further afield, [Villa Picasso Tulum](/developments/villa-picasso-tulum) in Mexico was completed in July 2023 and, by our own account, earned rental income every month for its first two years.

**Checkable outside our marketing.** Our developer profile is listed on FazWaz, Hipflat and HomesThailand, and the Portofino villas appear there too. Being able to check a developer independently is one of the tests.

**A name check.** Villa Picasso Ko Samui, in Taling Ngam, is a different house from Villa Picasso Tulum in Mexico. They share a name and nothing else.

If a developer cannot answer the checklist, no quality of finish makes off-plan safe. That applies to us too.

## Off-plan or finished: which suits you?

If off-plan still feels too risky, there is a simpler route: buy a villa that is already built. You give up the early advantages and gain certainty.

- **If you want the lowest risk:** buy finished. You inspect the real villa, and nothing is left to build.
- **If you want an early choice of position:** buy off-plan, from a developer who passes the checklist.
- **If you want a say in the finish:** buy off-plan, and get the specification in writing.
- **If you want a fixed budget:** buy finished. The villa and the price are known.

Either way, the ownership question sits underneath. For the wider picture, read [how to buy or build property in Koh Samui as a foreigner](/articles/how-to-buy-or-build-property-koh-samui-foreigner).

## Questions people ask

### Is it safe to buy off-plan in Koh Samui?

It can be, if the developer has finished and handed over similar villas before. The main risk is delivery. Protect yourself with dated, finished projects you can visit, payments tied to build stages, and your own Thai lawyer checking the title and contract.

### How do I check a Koh Samui developer's track record?

Visit their finished villas in person and check the completion dates. Ask for a project they finished and sold. Check whether they still run what they built, and look them up on independent property sites.

### Should my deposit be held in escrow?

Ask your lawyer whether escrow is available for your deal. Escrow means a neutral party holds the money until agreed conditions are met. If it is not used, insist on payments released only at stages you can see.

### What title should the land have?

Ideally a chanote, the strongest and fully surveyed Thai title deed. The way you hold the villa must also be legal and transfer cleanly to you. An independent Thai property lawyer should confirm both.

### What happens if the developer does not finish?

That is the core risk of off-plan. Your contract should set a completion date and say what happens if the build is late or stops.

Staged payments and a strong track record are your best protection. We explain build costs and timelines in [what it costs to build a villa on Koh Samui](/articles/cost-to-build-villa-koh-samui).

## Before you pay a deposit

Off-plan rewards the buyer who does the dull work. Visit the finished buildings, check the dates, hire your own lawyer, stage the payments, and read what the contract says about delays.
